A cet \u00e9gard, la Cour de cassation a consid\u00e9r\u00e9 qu&rsquo;un employeur manquait \u00e0 cette obligation, quand bien m\u00eame il aurait pris des mesures afin de rem\u00e9dier \u00e0 la situation, quand un salari\u00e9 se retrouve \u00eatre victime de violences physiques ou morales par un ou d&rsquo;autres salari\u00e9s sur son lieu de travail.<\/p>\n<p style=\"text-align: justify;\">En effet, c&rsquo;est la <strong>circonstance en elle-m\u00eame qui est r\u00e9pr\u00e9hensible<\/strong> d\u00e8s lors que l&rsquo;agression se produit sur le lieu de travail, ce qui engage la responsabilit\u00e9 de l&#8217;employeur, quand bien m\u00eame il ait pris des mesures pour mettre un terme \u00e0 cet agissement et que l&rsquo;incident ne soit pas de son fait.<\/p>\n<p style=\"text-align: justify;\">L&rsquo;agression constitue de ce fait un manquement \u00e0 l&rsquo;obligation de s\u00e9curit\u00e9 de l&#8217;employeur, et le salari\u00e9 victime peut pr\u00e9tendre, au titre de l&rsquo;ex\u00e9cution fautive du contrat de travail, \u00e0 des dommages-int\u00e9r\u00eats.<\/p>\n<p>Source :<\/p>\n<p>www.juritravail.com<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Selon l&rsquo;article L. 4121-1 du Code du travail, l&#8217;employeur est tenu de prendre les mesures n\u00e9cessaires en vue d&rsquo;assurer et de prot\u00e9ger la sant\u00e9 physique et mentale des travailleurs.
