{"id":7034,"date":"2016-09-26T09:20:05","date_gmt":"2016-09-26T07:20:05","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=7034"},"modified":"2016-09-26T09:20:05","modified_gmt":"2016-09-26T07:20:05","slug":"loi-travail-quen-est-il-des-heures-supplementaires","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2016\/09\/26\/loi-travail-quen-est-il-des-heures-supplementaires\/","title":{"rendered":"Loi travail : qu&rsquo;en est-il des heures suppl\u00e9mentaires ?"},"content":{"rendered":"<h2>Les apports de la loi travail quant \u00e0\u00a0la majoration des heures suppl\u00e9mentaires<\/h2>\n<p>La loi Travail ne modifiera pas les taux de r\u00e9f\u00e9rence de la <strong>majoration des heures suppl\u00e9mentaires<\/strong>, tant au niveau l\u00e9gal que conventionnel :<\/p>\n<ul>\n<li>les taux de majorations \u00ab par d\u00e9faut \u00bb, applicables en l\u2019absence d\u2019accord collectif sur le sujet, restent fix\u00e9s \u00e0 25 % et 50 %<\/li>\n<li>il sera toujours possible de pr\u00e9voir d\u2019autres taux par accord collectif, avec un minimum de 10 %<\/li>\n<\/ul>\n<p>Le point principal du changement issu de la loi concerne le principe de <strong>faire primer l\u2019accord d\u2019entreprise ou d\u2019\u00e9tablissement sur l\u2019accord de branche<\/strong>, ind\u00e9pendamment de la date \u00e0 laquelle l\u2019accord de branche a \u00e9t\u00e9 conclu (c. trav.art. L. 3121-33, 1\u00b0 modifi\u00e9). Il s\u2019agit donc effectivement d\u2019un assouplissement, dont le but est d\u2019effacer les obstacles repr\u00e9sent\u00e9s par les \u00ab clauses de verrouillage \u00bb et la r\u00e8gle interdisant de d\u00e9roger aux accords de branche ant\u00e9rieurs au 7 mai 2004 (loi \u00e0 para\u00eetre, art. 62).<\/p>\n<p>Ce ne sera possible que s\u2019il existe, au niveau de l\u2019entreprise ou de l\u2019\u00e9tablissement, des partenaires sociaux pour signer un accord valide.
