{"id":7451,"date":"2017-01-09T15:29:36","date_gmt":"2017-01-09T13:29:36","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=7451"},"modified":"2017-06-09T09:17:46","modified_gmt":"2017-06-09T07:17:46","slug":"bareme-indemnites-licenciement","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2017\/01\/09\/bareme-indemnites-licenciement\/","title":{"rendered":"Publication du bar\u00e8me des indemnit\u00e9s de licenciement sans cause r\u00e9elle et s\u00e9rieuse"},"content":{"rendered":"<p style=\"text-align: justify;\">Le d\u00e9cret n\u00b0 2016-1581 du 23 novembre 2016 portant fixation du <strong>r\u00e9f\u00e9rentiel indicatif d&rsquo;indemnisation<\/strong> pr\u00e9vu \u00e0 l&rsquo;article L. 1235-1 du Code de travail, et le d\u00e9cret n\u00b0 2016-1582 du 23 novembre 2016 modifiant le bar\u00e8me de l&rsquo;indemnit\u00e9 forfaitaire de conciliation fix\u00e9 \u00e0 l&rsquo;article D. 1235-21 du Code du travail, ont \u00e9t\u00e9 publi\u00e9s dans le JORF du 25 novembre 2016.<\/p>\n<p style=\"text-align: justify;\">Si le conseil des prud&rsquo;hommes juge que le salari\u00e9 requ\u00e9rant a fait l&rsquo;objet d&rsquo;un licenciement sans cause r\u00e9elle ni s\u00e9rieuse, il lui appartient de fixer le<strong> montant des dommages et int\u00e9r\u00eats<\/strong> qui seront vers\u00e9s par l&#8217;employeur au salari\u00e9. Ainsi, en cas de licenciement injustifi\u00e9, les juges ont dor\u00e9navant une base sur laquelle s&rsquo;appuyer pour la d\u00e9termination de ce montant.<\/p>\n<p style=\"text-align: justify;\">Le bar\u00e8me publi\u00e9 prend en compte l&rsquo;anciennet\u00e9 du salari\u00e9 au sein de l&rsquo;entreprise. Ainsi, pour un salari\u00e9 avec moins d&rsquo;un an d&rsquo;anciennet\u00e9, le montant des dommages et int\u00e9r\u00eats propos\u00e9s par le bar\u00e8me correspond \u00e0 1 mois de salaire, 8,5 mois de salaire pour un salari\u00e9 ayant pass\u00e9 10 ans au sein de l&rsquo;entreprise,\u00a0 et l&rsquo;\u00e9quivalent de 21,5 mois de salaire pour le salari\u00e9 qui a plus de 43 ans d&rsquo;anciennet\u00e9 (voir le tableau ci-dessous).<\/p>\n<p style=\"text-align: justify;\">En outre, si le demandeur \u00e9tait \u00e2g\u00e9 d&rsquo;<strong>au moins 50 ans \u00e0 la date de rupture<\/strong>, les montants indiqu\u00e9s dans le r\u00e9f\u00e9rentiel sont <strong>major\u00e9s d&rsquo;un (01) mois<\/strong>. C&rsquo;est \u00e9galement le cas si, la <strong>situation personnelle<\/strong> ou le <strong>niveau de qualification du demandeur<\/strong> \u00e0 l&rsquo;\u00e9gard de la situation du march\u00e9 du travail au niveau local ou dans le secteur d&rsquo;activit\u00e9 consid\u00e9r\u00e9, constitue un cas de <strong>difficult\u00e9s particuli\u00e8res de retour \u00e0 l&#8217;emploi du demandeur<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Pour rappel, cette indemnisation pour licenciement injustifi\u00e9e est per\u00e7ue, en outre des droits occasionn\u00e9s par la rupture du contrat de travail du salari\u00e9, tels que l&rsquo;indemnit\u00e9 l\u00e9gale ou conventionnelle de licenciement, l&rsquo;indemnit\u00e9 compensatrice de pr\u00e9avis, indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s.<\/p>\n<table class=\"alignleft\" style=\"height: 760px; width: 647.517px; border-color: #631313;\" border=\"1,5\">\n<caption><strong><strong>R\u00e9f\u00e9rentiel indicatif
