{"id":7605,"date":"2017-02-07T12:23:56","date_gmt":"2017-02-07T10:23:56","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=7605"},"modified":"2017-06-09T09:17:04","modified_gmt":"2017-06-09T07:17:04","slug":"droit-deconnexion-management","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2017\/02\/07\/droit-deconnexion-management\/","title":{"rendered":"Droit \u00e0 la d\u00e9connexion : une question manag\u00e9riale ?"},"content":{"rendered":"<p style=\"text-align: justify\">\u00c0 cet effet, \u00e0 compter du 1<sup>er<\/sup> janvier 2017, selon l&rsquo;article L. 2242-8 du Code du travail, une n\u00e9gociation collective doit porter sur les modalit\u00e9s de l&rsquo;exercice effectif par le salari\u00e9 de son droit \u00e0 la d\u00e9connexion, et la mise en place par l\u2019entreprise de <strong>m\u00e9canismes de r\u00e9gulation de l\u2019utilisation des outils num\u00e9riques<\/strong>, afin d&rsquo;assurer le respect de l&rsquo;\u00e9quilibre entre vie professionnelle et vie personnelle, notamment le temps de repos et de cong\u00e9.<\/p>\n<p style=\"text-align: justify\">Selon l&rsquo;article L. 2241-1 du Code du travail, ce nouveau dispositif est applicable au niveau des entreprises\u00a0 fran\u00e7aises de plus de 50 salari\u00e9s dans lesquelles sont constitu\u00e9es une ou plusieurs sections syndicales d&rsquo;organisations repr\u00e9sentatives, qui sont les seules soumises aux n\u00e9gociations annuelles obligatoires au niveau de l&rsquo;entreprise.<\/p>\n<p style=\"text-align: justify\"><strong>Si un accord n&rsquo;est pas conclu, l\u2019employeur devra \u00e9laborer une charte<\/strong>, apr\u00e8s avis du comit\u00e9 d\u2019entreprise ou \u00e0 d\u00e9faut, des d\u00e9l\u00e9gu\u00e9s du personnel. Cette charte d\u00e9finit les modalit\u00e9s de l\u2019exercice du droit \u00e0 la d\u00e9connexion et pr\u00e9voit en outre la mise en \u0153uvre, \u00e0 destination des salari\u00e9s et du personnel d\u2019encadrement et de direction, d\u2019actions de formation et de sensibilisation \u00e0 un usage raisonnable des outils num\u00e9riques.<\/p>\n<p style=\"text-align: justify\">Cependant, le sujet du droit \u00e0 la d\u00e9connexion soul\u00e8ve la question du v\u00e9ritable apport de ce nouveau droit qui, de facto, est d\u00e9j\u00e0 existant dans le sens d&rsquo;une distinction entre heures de travail et temps de repos et de cong\u00e9s, pour chaque salari\u00e9. Dans ce sens, l&rsquo;<strong>essor des nouveaux modes de travail<\/strong> comme le travail \u00e0 distance, ou la mobilit\u00e9 internationale des effectifs qui doivent concilier des heures de travail atypiques&#8230; sont des challenges que les entreprises doivent int\u00e9grer dans les discussions avec les organisations repr\u00e9sentatives du personnel, d&rsquo;autant plus que c&rsquo;est aux entreprises de d\u00e9finir (la loi ne pr\u00e9cise aucune exigence quant aux modalit\u00e9s d&rsquo;application du droit \u00e0 la d\u00e9connexion), en consensus avec les salari\u00e9s, ce qui est acceptable de ce qui ne l&rsquo;est pas.<\/p>\n<p style=\"text-align: justify\">Pris du c\u00f4t\u00e9 du management, le droit \u00e0 la d\u00e9connexion renvoie \u00e0 une image de laisser-aller, voire un d\u00e9bordement dans le syst\u00e8me manag\u00e9rial.
