{"id":8865,"date":"2018-02-02T12:56:39","date_gmt":"2018-02-02T10:56:39","guid":{"rendered":"https:\/\/www.gereso.com\/actualites\/?p=8865"},"modified":"2018-02-05T17:27:24","modified_gmt":"2018-02-05T15:27:24","slug":"ordonnance-macron-exercice-du-droit-syndical","status":"publish","type":"post","link":"https:\/\/www.gereso.com\/actualites\/2018\/02\/02\/ordonnance-macron-exercice-du-droit-syndical\/","title":{"rendered":"L&rsquo;ordonnance \u00ab Macron \u00bb relative \u00e0 l\u2019exercice du droit syndical"},"content":{"rendered":"<h2><strong><span style=\"color: #d10016;\">\u00c9largissement de l\u2019entretien de fin de mandat<\/span> <\/strong><\/h2>\n<p>La loi Rebsamen du 17 ao\u00fbt 2015 avait pr\u00e9vu qu\u2019un salari\u00e9 nouvellement \u00e9lu ou titulaire d\u2019un mandat syndical puisse demander \u00e0 son employeur la tenue d\u2019un entretien de d\u00e9but de mandat portant sur les modalit\u00e9s pratiques d\u2019exercice de son mandat au regard de son emploi dans l\u2019entreprise. Par ailleurs, \u00e0 la fin du mandat, cet entretien \u00e9tait obligatoire pour les repr\u00e9sentants du personnel titulaires disposant d\u2019heures de d\u00e9l\u00e9gation repr\u00e9sentant, sur l\u2019ann\u00e9e, au moins 30 % de la dur\u00e9e du travail pr\u00e9vue \u00e0 leur contrat de travail, afin de proc\u00e9der au recensement des comp\u00e9tences acquises au cours du mandat et de pr\u00e9ciser les modalit\u00e9s de valorisation de l\u2019exp\u00e9rience acquise.<\/p>\n<p>Les ordonnances \u00e9largissent l\u2019obligation de tenir cet entretien de fin de mandat. D\u00e9sormais, cet entretien est obligatoire dans toutes les entreprises de plus de 2 000 salari\u00e9s pour les repr\u00e9sentants du personnel titulaires ou ayant un mandat syndical ; peu important leur volume d\u2019heures de d\u00e9l\u00e9gation. En dessous de 2 000 salari\u00e9s, l\u2019entretien ne reste obligatoire que pour les repr\u00e9sentants disposant d\u2019heures de d\u00e9l\u00e9gation qui repr\u00e9sentent 30 % de leur dur\u00e9e du travail sur l\u2019ann\u00e9e.<\/p>\n<p>Ces nouvelles dispositions sont applicables uniquement aux mandats prenant effet apr\u00e8s le 31 d\u00e9cembre 2019. Elles ne rentreront donc en vigueur qu\u2019au 1er janvier 2020 pour tous les salari\u00e9s concern\u00e9s.<\/p>\n<h2><strong><span style=\"color: #d10016;\">Possibilit\u00e9 d\u2019une mise \u00e0 disposition d\u2019une organisation syndicale<\/span> <\/strong><\/h2>\n<p>Avec son accord, expr\u00e8s, un salari\u00e9 peut \u00eatre mis \u00e0 disposition d\u2019une organisation syndicale ou d\u2019une association d\u2019employeurs, selon les termes pr\u00e9vus par un accord collectif de branche \u00e9tendu ou d\u2019entreprise. Dans ce contexte, il ne faut pas oublier que les obligations de l\u2019employeur \u00e0 l\u2019\u00e9gard du salari\u00e9 sont maintenues pendant cette mise \u00e0 disposition supposant notamment que l\u2019accord pr\u00e9voit des am\u00e9nagements de nature \u00e0 permettre \u00e0 l\u2019employeur de respecter son obligation de formation et d\u2019adaptation des salari\u00e9s.<\/p>\n<h2><span style=\"color: #d10016;\"><strong>Le cong\u00e9 de formation \u00e9conomique, social et syndical<\/strong><\/span><\/h2>\n<p>Dor\u00e9navant, le salari\u00e9 a droit a droit au maintien total de sa r\u00e9mun\u00e9ration lors d\u2019un des cong\u00e9s de formation, cotisations sociales comprises. En revanche, l\u2019employeur peut d\u00e9duire le montant du salaire et des contributions sociales aff\u00e9rentes \u00e0 la r\u00e9mun\u00e9ration maintenue de sa cotisation au financement du dialogue social. Les conditions de cette d\u00e9ductibilit\u00e9 seront d\u00e9finies dans des conditions et des modalit\u00e9s fix\u00e9es par d\u00e9cret en Conseil d\u2019\u00c9tat.<\/p>\n<h2><span style=\"color: #d10016;\"><strong>Evolution du fonds paritaire pour le financement du dialogue social<\/strong><\/span><\/h2>\n<p>En 2014, a \u00e9t\u00e9 institu\u00e9 un fonds paritaire de financement des organisations syndicales de salari\u00e9s et d\u2019employeurs, via une contribution patronale de 0,016 %.
