existait un principe de <strong>primaut\u00e9 de l&rsquo;accord de branche sur l&rsquo;accord d&rsquo;entreprise,<\/strong> la loi travail d\u2019ao\u00fbt 2016 et les ordonnances Macron de septembre 2017 sont venues <strong>modifier la hi\u00e9rarchie des normes<\/strong> en faisant d\u00e9sormais primer les accords d&rsquo;entreprise sur les accords de branche dans de nombreux domaines du droit du travail.<\/p>\n<h2><span style=\"color: #d10016;\"><strong>Accords d\u2019entreprise, mode d\u2019emploi<\/strong><\/span><\/h2>\n<p>L&rsquo;accord d&rsquo;entreprise est n\u00e9goci\u00e9 avec les <strong>repr\u00e9sentants du personnel.<\/strong> En pratique, il peut s&rsquo;agir de d\u00e9l\u00e9gu\u00e9s syndicaux, de membres du comit\u00e9 d&rsquo;entreprise ou de \u00a0d\u00e9l\u00e9gu\u00e9s du personnel.<\/p>\n<p>Si l\u2019entreprise ne comporte pas de d\u00e9l\u00e9gu\u00e9s syndicaux et que son effectif habituel est compris<strong> entre 11 et moins de 50 salari\u00e9s,<\/strong> il est d\u00e9sormais possible, depuis les ordonnances Macron, de n\u00e9gocier, conclure ou r\u00e9viser un accord d&rsquo;entreprise ou d&rsquo;\u00e9tablissement <strong>avec un ou plusieurs salari\u00e9s mandat\u00e9s.<\/strong><\/p>\n<p>Une fois sign\u00e9 et notifi\u00e9 aux organisations repr\u00e9sentatives, l&rsquo;accord collectif d&rsquo;entreprise doit \u00eatre d\u00e9pos\u00e9 aupr\u00e8s de la direction r\u00e9gionale des entreprises, de la concurrence, de la consommation, du travail et de l&#8217;emploi (Direccte) du lieu de sa conclusion.<\/p>\n<h2><span style=\"color: #d10016;\"><strong>Les r\u00e8gles de validit\u00e9<\/strong><\/span><\/h2>\n<p>Pour qu\u2019une n\u00e9gociation collective d\u00e9bouche sur un accord collectif valable, il faut une <strong>condition majoritaire en termes de suffrage<\/strong>, c\u2019est-\u00e0-dire que les signataires d\u2019un accord doivent repr\u00e9senter <strong>au moins 50\u00a0% des suffrages valablement exprim\u00e9s au premier tour<\/strong> des derni\u00e8res \u00e9lections professionnelles, et ce, quel que soit le nombre de votants.<\/p>\n<p>Si l\u2019accord n\u2019obtient pas les 50\u00a0% et plus d\u00e8s la signature, mais obtient <strong>au moins 30\u00a0% des suffrages<\/strong> recueillis en faveur des organisations syndicales repr\u00e9sentatives, l\u2019un des syndicats signataires peut d\u00e9cider de lancer une <strong>proc\u00e9dure de r\u00e9f\u00e9rendum d\u2019entreprise,<\/strong> dans un d\u00e9lai d\u2019un mois \u00e0 compter de la signature de l\u2019accord<em>.<\/em><\/p>\n<p>Si, dans les 8 jours qui suivent cette demande, les \u00e9ventuelles signatures d\u2019autres organisations syndicales repr\u00e9sentatives ne permettent pas d\u2019atteindre plus de 50\u00a0% des suffrages, la <strong>consultation des salari\u00e9s<\/strong> est organis\u00e9e dans un <strong>d\u00e9lai de 2 mois.<\/strong><\/p>\n<p>Si l\u2019accord est pl\u00e9biscit\u00e9 et obtient une majorit\u00e9 de suffrage, il sera alors valide pour rentrer en phase d\u2019application.<\/p>\n<h2><span style=\"color: #d10016;\"><strong>Les th\u00e8mes ouverts \u00e0 la n\u00e9gociation collective d\u2019entreprise<\/strong><\/span><\/h2>\n<p>Dans le cadre de l\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000035607311&amp;categorieLien=id\" target=\"_blank\" rel=\"noopener\">ordonnance n\u00b0 2017-1385 du 22 septembre 2017<\/a> relative au renforcement de la n\u00e9gociation collective, l\u2019accord de branche continue \u00e0 s\u2019imposer \u00e0 l\u2019accord d\u2019entreprise \u00a0dans <strong>15 domaines de comp\u00e9tences<\/strong> tels qu&rsquo;\u00e9nonc\u00e9s dans l\u2019article 1\u00a0:salaires minima,mesures relatives \u00e0 la dur\u00e9e du travail et \u00e0 l\u2019am\u00e9nagement des horaires, \u00e9galit\u00e9 professionnelle femmes-hommes&#8230;<\/p>\n<p>Pour tous les autres domaines, <strong>l&rsquo;accord d&rsquo;entreprise prime.<\/strong> Lui seul peut s&rsquo;appliquer, y compris
